The prosecutor is going to report on the Drain Commissioner, Gary Holzhausen, at Tuesdays County Commissioner's Committee of the Whole meeting.

He may even have decided if he is going to prosecute by then.

Unless there was something that wasn't mentioned in the press I don't see how they could prosecute the guy. But then again anything is possible in Shiawassee County.

I wish when they are scrutinizing everyone out there trying to make a living they would ask them how many bids were taken for all of the Sherrif fleet of cars, they just so happen to all go to Terry Walkers sons new business, if he was the lowest bid so be it, but somehow I doubt there was an opportunity for others.

Close but Terry Walkers son just services all the patrol cars for county he is by the Charter Cable Co. I just think this is a whole lot of unfair practices and then they write Gary H. a check and call him a theif, what a group for us to not be proud of.

I am interested in hearing the big explanation. It better be more than what I have read in the paper and include more than just H's term of office. I'd hate to see them with egg on their faces.
As a matter of fact I am for investigating everyone.
ML's post doesn't shock me. I've heard worse things that are going on over there.
cpdc's idea of an IG is sounding better every day. I just don't know how you would find one that would be honest and fair enough.
If cpdc could answer that question with a good explanation, I'd be for an IG in a heartbeat.

Kennel licensing for the illegally operating veterinary clinic kennels was not on the agenda
What I learned will take me a while to write up, then I will send as letter to the editor

Colbry brought out two new bits of information
1. Holzhausen charged a "waiver" fee.whatever that was
2. One of H's employees told Colbry he/she overheard something that would indicate a personal threat to Colbry
Colbry is recommending to the State Police that the criminal charges be referred to the Attorney General because of item #2
Fuja questioned him about referring to the Governor - that would not be criminal charges and the commissioners could do that on their own - he would work on it with them.
After the meeting my friend questioned Sheriff Wilson about charging Bernie Butcher with the same criminal charges. His response was something to the effect would have to see what the statute of limitations was.........

I thought the criminal charges were for the unemployment claim, which would not apply to Bernie Butcher. As for the fees, that was all an administrative screwball thing anyway. Why waste time on that? Fix the policy & move on. If they are going to charge Gary for that, I'm still not sure they can charge Bernie because he had negotiated that compensation with the board in '92 ... or something like that.
I'm sure someone really threatened Colbry and that's why he has to defer to the AG. Bah! He was probably up all night trying to think of a way out. Colbry & Winegar are greasier than yesterday's bacon.***

It was my understanding that Holzhausen was up on "several criminal charges" and that he will definately be charged. Who will be the Prosecutor is the question. Colbry was quoted in saying that someone in Holzhausen's group had threatened his life and I believe the lives of his family(I can't remember right now if their lives were threatened also or not). So he will be trying to get someone on State level to do the prosecuting. There was even talk of a dismissal recommendation being sent to Governor Granholm. As for Bernie Butcher, they said that he may be liable for repaying the county money for "unnecessary fees" collected. That would probably be as far as it would go for Bernie.
So as you can see, it went beyond the unemployment issue. It covered pretty much all allegations against Holzhausen.

I thought the criminal charges were more than the unemployment thing. Actually, I thought the MESC would have to bring a complaint on that anyway.
I also think Colbry said he went back through the minutes, like forever, and found nothing that gave anyone authority to do that. So that would put Butcher in the game.
I'm sure all the papers will have a good story.

If the fees were negotiated as part of Bernie's compensation then it might not be in the minutes of the meetings. He was Deputy DC back then ... are employees' compensation details kept in the minutes? I really thought it was a board resolution though, which of course would be in the minutes.
As for not finding anything in the minutes, Colbry only went back a few years and then proclaimed there was nothing to authorize Gary to take fees. Then I told the board to look back to the when Bernie started the program, and at that point I understand they had Lauri Braid look, and she didn't find anything (though she did ask citizens to come forward if they had information). However it doesn't mean anything to me that she didn't find anything, because she also couldn't find page 8 of the county budget when I purchased a copy, and when I told her staff that it was missing, they told me she said that page 8 didn't exist. I had to tell her staff what was on page 8 before they believed that it existed and then arranged to get it for me.
In our county, absence of evidence is evidence of absence. If they don't see it, they are certain it must not exist.
By the way I guess if you are ever going to be charged with something, you should pretend to threaten to kill Colbry and he'll back off and ask the AG to do his work for him.

If they think it might jump out and bite them - let somebody else take care of it.
I think that technique works pretty good. I recently heard a story very similar about one of our previous prosecutors. Only this one just didn't prosecute somebody, at all. Was a much more serious crime than this, too. Actually, the crime was assault with a gun. Somebody assaulted somebody with a gun and when the prosecutor was threatened, he did not prosecute. Pretty sorry.
I also heard some think Colbry plans to run for judge someday, likely when Lostracco retires. Should that occur....I hope people remember what a courageous prosecutor he was ........( NOT )!

Barf. He's already the chief law enforcement officer in the county. Look what that's done for us.
But as a woman who BEGGED the police, prosecutor, and judge Lostracco for protection when I was being stalked by psycho-freak, and they couldn't be bothered to help me because they were too busy being important, I'd just like to say that I'm glad to see that Colbry has as much faith in the Shiawassee legal system as I do.

I had to deal with Colbry as an attorney at one point many, many years ago. He was assigned to me. He did absolutely NOTHING for me! I was so happy when a new attorney took over his position. Looks like things haven't changed with him after all of this time! Very scarey!
