 Post subject: NEW DOG CATCHER ON BOARD

Undersheriff Walker was at the Committee of the Whole meeting 3/20/07

I asked him if the new dog catcher was on board and he told me they didn't have a dog catcher.

Somehow he did get around to saying they had an "Animal Control Officer".
(actually, he said they have two)

I told him all those titles were the same, by state law.
Darn! Can't believe I was wrong on that. Not state law. It's the

SHIAWASSEE COUNTY
ANIMAL CONTROL ORDINANCE

ARTICLE II DEFINITIONS

(d) ANIMAL CONTROL OFFICER Means any person employed by the county for the purpose of enforcing this Ordinance or state statutes pertaining to dogs, or other animals as well as persons or deputies employed or designated by the county to act in the animal control division.
Animal Control Officer shall be synonymous with “pound master”, “Chief animal control services”, “dog warden” or “dog catcher”.

That says that. This is Shiawassee County and yup,new dog catcher on board

At Tuesday's Committee of the Whole meeting, I asked Under Sheriff Walker how our new dog catcher was doing.

He said he caught a couple that day.

I said, "You mean we actually have a dog catcher that catches dogs."

Yep......guess we do.

So, next time you have a stray running around your place and you call 911 for the dog catcher, don't let them tell you to call the Humane Society. The dog catcher does catch dogs.

I spose you would have to call when he is on duty. Other officers will not carry a dog in their cars.

FYI...the new dog catcher is a "Certified" police officer
no training documented as to handling/care/sanitation/etc of animals

This is legal and this is the guy that inspects kennels, and this is why the veterinarians had such fits about such a person inspecting their "kennel" that our county commissioners so graciously changed the ordinance to exclude veterinary clinics from the ranks of "kennel".

jmho. but I doubt if any kennel owner has much regard for such an idiot inspecting their kennel.

It is State Law and I have sent a complaint to my state rep! I really don't want ANY such idiot on my property, especially not one that hangs around the pound (animal control shelter (Animal Auschwitz) where there is all manner of disease.

Act 339 of 1919


287.289a Animal control agency; establishment; employees; jurisdiction; contents of animal control ordinance.

Sec. 29a.

The board of county commissioners by ordinance may establish an animal control agency which shall employ at least 1 animal control officer. The board of county commissioners may assign the animal control agency to any existing county department. The animal control agency shall have jurisdiction to enforce this act in any city, village or township which does not have an animal control ordinance. The county's animal control ordinance shall provide for animal control programs, facilities, personnel and necessary expenses incurred in animal control. The ordinance is subject to sections 6 and 30.


History: Add. 1972, Act 349, Imd. Eff. Jan. 9, 1973

That means the Shiawassee County Animal Control 'agency' does not have jurisdiction in any city, village or township which has an animal control ordinance.

There are several of those areas that I know of:

The City of Corunna
The City of Durand
The City of Owosso
The City of Perry
Caledonia TWP

No jurisdiction in those municipalities. There could be more, seems like there is at least one other township that has their own ordinance. Maybe more that I haven't come across, yet.

So, why does the city of Owosso take their stray animals to the county shelter? Seems like if they have their own ordinance, they should have their own shelter.

Oh yeah........none of those ordinances are written legally.
So they have an ordinance, that means the county dog catcher has no jurisdiction, but their ordinance isn't legal and so far I haven't found where any of them have an animal control officer. Their own police could enforce their illegal ordinances or state police could enforce state law.
