 Post subject: Improperly charged fees had to be paid back?

You know this is gonna stick in my craw...........

Why did the county have to pay these fees back? They were only "improperly" charged (as in without board authorization).

While the board did authorize and did charge kennel license fees in excess of what State law allows and they didn't pay back anything.

So if you "improperly" charge a fee, you have to pay it back. A fee that is reasonable in all aspects and not unlawful, but

If you illegally charge excessive fees, you don't have to pay them back.

Makes perfect sense, this is Shiawassee County. A Kingdom unto itself? Not really.
The county did not have to pay those fees back. That was their choice.

ok..but the local papers have not published my letters on animal control issues before. We'll see if they publish this one.

In your article on 3/21/07 titled "County may seek legal action against Holzhausen "

County should refund excessive fees before suing Holzhausen

hmmmmmmmmm not a bad idea about "should refund"

but I don't think they should sue Holzhausen anytime! and I didn't say that.

:shock: What makes this even more ridiculous is that the County needs to sue themselves!!!! They are charging $70 for the supposed terribly illegal fee that Holzhausen charged for $25!!! Why are they not telling you this??

NEW wording from Environmental Health.

Single Family or Multi Family Residential Unit (May not require $20 per month charge)
Minor-(Site plan review, Site visit, (Pole Barns) (No permit needed) -----$70.00

This is the exact same thing Mad Dog has gone mad about. He needs to sue himself and the whole county next!!!!!!!

The Permits cost $140 while Holzhausen charged $25. Mad Dog Colbry has really saved us some money...........NOT!!

The Board did not authorize the drain cmr to do this. They should have, but didn't. They don't want us to know they screwed up. More better to destroy the drain cmrs than admit their mistake

1. The Drain Cmr did the soil erosion inspections over and above his statutory drain cmr duties. He should be paid over and above his statutory pay for doing them and the board of cmrs should have authorized it.

2. Now the board has authorized and the inspections are being done by full time employees that were at risk of being laid off for lack of work. Full time employees with full time benefits are doing these inspections within their normal work schedule. (We could have had two or three less inspectors.) The fees go in the county coffers and the employees draw their full time pay- but maybe the county makes a little more profit with the increase in the fees?

3.Seems like somebody should do a cost analysis.

Yes, Yes this is the same thing as what was once called the dreaded "waiver" Holzhausen and his staff never liked that misleading term which was a hold over from the previous Drain Commissioners.

For the cost analysis: As long as Mad Dog is in office, the residents of Shiawassee County will continue to get screwed.

I don't understand the $20 per month on a Single Family or Multi Family Residential Unit.
What does that have to do with soil erosion? Is that a soil erosion fee?
I don't pay that...Who does? and when?

You have to contact Environmental Health to get the explanation. These fees are for soil erosion. It says "May not" so I don't think there is a monthly fee like for instance a "Wal-Mart" expansion soil erosion fee which would be a big project and have monthly fee's.
